Florida closing costs for buyers (2026): doc stamps, intangible tax and more

Updated October 19, 2026. 3 min read.

In Florida, a deed pays a state tax, the documentary stamp tax, of $0.70 for every $100 of the price, except in Miami-Dade, where it's $0.60 on single-family homes and $1.05 on other property. With a mortgage, the loan pays $0.35 per $100 plus a 0.2% intangible tax. Who pays each tax is up to the contract, so check it before you sign.

The taxes at a glance

The State of Florida sets them, and they're paid when the documents are recorded with the county.

Who pays them

The law doesn't say who pays the tax on the deed: the purchase contract decides. Check it before signing, especially when buying from a developer, since the developer drafts the contract. The mortgage taxes come with the loan, so the borrower usually pays them.

An example

A $400,000 home outside Miami-Dade, with a $320,000 mortgage (80%):

ItemAmount
Documentary stamp tax on the deed, $0.70 per $100$2,800
Documentary stamp tax on the mortgage, $0.35 per $100$1,120
Intangible tax, 0.2%$640

On top of that come title insurance, the closing agent's fees, the appraisal and lender fees. Title insurance and property taxes vary by county.

If you buy pre-construction

On a pre-construction purchase, these taxes are paid at closing, once the building is finished and the deed is signed. Before that you pay the deposits, which Florida law protects (buying a pre-construction condo in Miami).

How Digger helps

Digger AI Agent works out what you need before buying in the US: it assumes a typical 10% down payment plus 3% in closing costs, and the banks' rule that housing shouldn't exceed 28% of your income, or all your debts 36%. It's an estimate: the exact figure comes from each closing.

And if you buy with Instadigs, 100% of the Instadigs commission comes back to you as a credit on that same closing statement, through our licensed Florida broker (how it works and what the law says).

Frequently asked questions

How much is the documentary stamp tax in Florida?

$0.70 for every $100 of the price on the deed, except in Miami-Dade, where it's $0.60 on single-family homes and $1.05 on other property. The mortgage pays $0.35 per $100 of the loan.

What is Florida's intangible tax?

A 0.2% tax on the amount of a mortgage secured by Florida real estate. It's paid when the mortgage is recorded.

Who pays closing taxes in Florida, the buyer or the seller?

The purchase contract decides. The mortgage taxes are usually paid by the borrower.

Why does Miami-Dade have a different rate?

Because the law sets a $0.60 per $100 rate for Miami-Dade, with a $0.45 surtax on property that isn't a single-family home.

How much should I save for closing costs in Florida?

It depends on the price, the county and whether there's a mortgage. Digger uses 3% of the price as an estimate, on top of the down payment.
